NOTICE OF ORDINANCE INTRODUCTION

 

The ordinance published herewith was introduced and passed upon first reading at a meeting of the Governing Body of the Township of Morris, a municipal corporation of the State of New Jersey (the “Township”), that was held on Wednesday, January 21, 2026 (in-person and via ZOOM).  It will be further considered for final passage, after public hearing thereon, at a regular meeting of the Governing Body to be held at the Municipal Building (in-person and as a courtesy via ZOOM) on Wednesday, February 18, 2026, at 7:00 pm.  Please visit the Township website www.morristwp.com prior to the meeting for the agenda and additional instructions.

 

ORDINANCE NO.   01-26

 

AN ORDINANCE OF THE TOWNSHIP OF MORRIS AUTHORIZING THE EXECUTION OF AN AMENDED HISTORIC PRESERVATION EASEMENT AGREEMENT BETWEEN THE TOWNSHIP OF MORRIS, THE TOWN OF MORRISTOWN AND THE MORRIS COUNTY BOARD OF COUNTY COMMISSIONERS 

            

WHEREAS, the Township of Morris (the “Township”) along with the Town of Morristown are the Grantors of a Historic Preservation Easement for a property located at 1 Miller Road, Morristown, NJ 07960 and known as the Morristown & Morris Township Library (the “Property”) to the Morris County Board of County Commissioners (the “Grantee”); and

 

WHEREAS, the Grantors and Grantee executed a Historic Preservation Easement on January 13, 2016 in connection with the acceptance of one grant (2011 grant) for Exterior Restoration of the Property; and

 

WHEREAS, the Grantors have accepted one grant (2023 grant) to fund for the historic preservation of additional portions of the site and Willis Wing Repairs of the Property; and 

 

WHEREAS, the Grantors and Grantee desire to amend the Historic Preservation Easement Agreement to include the addition of specified portions of the site and the structure known as Morristown & Morris Township Library covered by the 2023 grant; and 

 

WHEREAS, the amended is to become effective on February 11, 2026 and remain in full force and effect for a period of thirty (30) years until February 11, 2056; and 

 

WHEREAS, the Committee desires to authorize the Mayor and Clerk to execute the Amended Historic Preservation Easement Agreement in a manner substantially similar to that set forth herein as Exhibit “A”; and 

 

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Morris as follows: 

 

SECTION ONE:  

 

The Mayor and Township Clerk are hereby authorized to execute the Amended Historic Preservation Easement Agreement based upon the terms and conditions set forth herein and, in a manner, substantially similar to the one attached hereto as Exhibit “A”.

 

SECTION TWO: 

 

If any portion of this ordinance shall be deemed invalid by any court of competent jurisdiction, the remainder shall survive in full force and effect. 

 

SECTION THREE:  

 

All Ordinances of the Township of Morris which are inconsistent with the provisions of this Ordinance are hereby repealed to the extent of such inconsistency.

 

SECTION FOUR:  

 

This Ordinance shall take effect upon final passage and publication thereof, as provided for by law.
